Eigenverwaltung (debtor-in-possession management under Sections 270 et seq. of the German Insolvency Code) allows the company’s management to remain operationally active while an insolvency monitor (Sachwalter) supervises the process. In this context, the asset deal helps to generate liquidity to finance the restructuring without control of the company having to be given up entirely.
